1. Introduction

These Terms & Conditions (“Terms”) govern your use of marketingfezzi.com (“the Website”) and any freelance services provided by Muhammad Fiaz (“I”, “me”, or “my”). By accessing this Website or engaging my services, you agree to be bound by these Terms.

Please read these Terms carefully before commissioning any work. If you do not agree with any part of these Terms, please do not use this Website or engage my services.

2. Services

I provide the following freelance digital marketing and web design services:

Meta Ads (Facebook & Instagram advertising campaigns)
TikTok Ads (TikTok advertising campaigns)
Google Ads (Search, Display, and Shopping campaigns)
Shopify Store Design & Development
WordPress Business Website Design
Advanced Tracking Setup using GTM

The exact scope of work, deliverables, timeline, and pricing for each project are agreed upon individually before any work commences. All agreements are confirmed in writing via email or messaging platforms.

I reserve the right to decline any project at my discretion without obligation to provide a reason.

3. Project Agreement & Scope of Work

Before any project begins, we will agree on:

The full scope of work and deliverables
Project timeline and milestones
Total cost and payment schedule
Number of revisions included

Any work requested beyond the agreed scope will be treated as additional work and may incur additional charges. I will notify you before proceeding with any out-of-scope work.

Changes to the project scope after work has begun may affect the timeline and cost. Any such changes must be agreed upon in writing by both parties.

4. Revisions

The number of revisions included in each project is agreed upon individually at the start of each engagement and confirmed in writing before work begins. This varies depending on the nature and complexity of the project.

A revision is defined as minor adjustments to the agreed deliverable. Revisions do not include changes to the original project brief, new features, or significant redesigns — these will be treated as additional work.

Revision requests must be submitted in a single, consolidated list rather than in multiple separate rounds, unless otherwise agreed.

5. Payment Terms

Payment for services is accepted via multiple methods including bank transfer, Easypaisa, JazzCash, PayPal, and other mutually agreed methods. For projects handled through Fiverr or Upwork, payment is processed through Fiverr’s platform or Upwork.

Unless otherwise agreed in writing, the following payment schedule applies:

50% deposit required upfront before work begins
Remaining 50% due upon project completion before final files are delivered

For ongoing services such as ad campaign management, payment terms will be agreed upon at the start of the engagement (monthly retainer or per-milestone).

All prices are quoted in USD unless otherwise specified. I reserve the right to update my pricing at any time, though agreed project prices will not change once work has commenced.

Late payments may result in work being paused until the outstanding balance is settled.

6. Refund Policy

I am committed to delivering high-quality work. The following refund policy applies to all direct client engagements:

If work has not yet started: A partial refund will be issued. The deposit minus any administrative or planning costs already incurred will be returned.
If work has started: No refund will be issued once work is underway, as time and resources have already been committed to your project.
For Fiverr orders: Fiverr’s own refund and cancellation policy applies.
For Upwork orders: Upwork’s own refund and cancellation policy applies.

Refund requests must be submitted in writing via email. I will review each request and respond within 5 business days.

Refunds are not provided for dissatisfaction due to change of mind, changes to business direction, or factors outside my control such as ad platform policy changes or algorithm updates.

7. Advertising Campaign Results & Disclaimer

I will apply my professional expertise, experience, and best practices to all advertising campaigns. However, I cannot and do not guarantee specific results such as a defined return on ad spend (ROAS), number of leads, sales figures, or revenue targets.

Advertising campaign performance is influenced by numerous external factors beyond my control, including:

Ad platform algorithms and policy changes (Meta, Google, TikTok)
Market conditions and competition
Product or service quality and pricing
Landing page and website performance
Seasonal trends and economic factors

My responsibility is to set up, manage, and continuously optimise campaigns to the best of my ability based on available data. Results may vary and past performance does not guarantee future results.

8. Client Responsibilities

To ensure the successful delivery of services, the client agrees to:

Provide all necessary materials, assets, access credentials, and information in a timely manner
Provide access to required platforms (e.g. Facebook Business Manager, Google Ads account, Shopify admin, WordPress dashboard) where applicable
Review and approve deliverables within a reasonable timeframe
Ensure that all materials provided to me do not infringe on any third-party intellectual property rights
Communicate changes to project requirements promptly and in writing

Delays caused by the client’s failure to provide required materials or approvals may affect the agreed project timeline. I will not be held responsible for such delays.

9. Intellectual Property

Upon receipt of full and final payment, all completed deliverables and work product created specifically for your project will become your property.

I retain the right to:

Display completed work in my portfolio (on this Website, Fiverr, or social media) unless you request confidentiality in writing
Use general knowledge and techniques gained during the project for future clients

I do not transfer ownership of any third-party tools, plugins, themes, stock images, or software used in the project. Their usage is subject to their respective licensing agreements.

You warrant that any materials, logos, images, or content you provide to me do not infringe the intellectual property rights of any third party. You agree to indemnify me against any claims arising from such infringement.

10. Confidentiality

I treat all client information as confidential. I will not share your business information, strategies, ad account data, or any other sensitive information with third parties without your written consent, except where required by law.

This confidentiality obligation does not apply to information that is or becomes publicly available through no fault of mine, or information I am required to disclose by law or regulation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or loss of goodwill arising from or in connection with my services.

My total liability to you for any claim arising out of or in connection with these Terms or my services shall not exceed the total amount paid by you for the specific project giving rise to the claim.

12. Termination

Either party may terminate a project engagement by providing written notice. In the event of termination:

You will be invoiced for all work completed up to the date of termination
Any amounts already paid that exceed the value of work completed will be refunded at my discretion, minus reasonable costs already incurred
If you terminate after work has begun, the deposit is non-refundable

I reserve the right to terminate an engagement immediately if a client acts in a manner that is abusive, unethical, or in violation of these Terms, without any obligation to issue a refund.

13. Governing Law

These Terms & Conditions are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising from these Terms or my services shall first be attempted to be resolved amicably between both parties.

If a resolution cannot be reached, disputes shall be subject to the jurisdiction of the courts of Rawalpindi/Islamabad, Pakistan.

For international clients, I make every effort to resolve disputes fairly and professionally. These Terms do not limit any statutory rights you may have under the laws of your own country.

14. Changes to These Terms

I reserve the right to update these Terms & Conditions at any time. The revised version will be posted on this page with an updated “Last Updated” date. Continued use of this Website or my services after any changes constitutes your acceptance of the updated Terms.

For ongoing project engagements, the Terms agreed upon at the start of the project will remain in effect for the duration of that project.
